These terms and conditions govern all orders placed on the Abaca Florist website.
Conclusion of the contract
The order is considered firm and final upon receipt of full payment.
Abaca Florist reserves the right to refuse any order, particularly in the event of product unavailability, incomplete information or payment problems.
A confirmation email is sent after the order is validated.
Price and payment
All prices are listed in Canadian dollars (CAD) and are subject to applicable taxes.
Delivery charges are calculated at checkout.
Full payment is required at the time of ordering.
Product availability and substitutions
Our floral creations are composed of fresh, seasonal flowers.
Due to their handcrafted and perishable nature, some flowers or containers may vary depending on availability.
In the event of unavailability, Abaca Florist reserves the right to substitute an item of equivalent value, quality, and style. The spirit and value of the arrangement will always be respected.
The photos shown on the website are for illustrative purposes only. They generally represent a "standard" size and may differ slightly from the delivered product.
Delivery and pickup
Delivery date
The date selected by the customer constitutes a target delivery date.
Delivery is made on the chosen day, subject to availability and after confirmation with the recipient.
Requests for delivery at a specific time cannot be guaranteed, except in the case of funerals.
Same day delivery in Montreal is generally possible for orders received before 12pm (Monday to Saturday), subject to availability and service area.
Hand delivery
To ensure the quality and integrity of the products, all deliveries are made by hand.
Abaca Florist will contact the recipient before delivery to confirm their presence and agree on an approximate time slot.
We do not leave any orders at the door or with a neighbor.
A valid phone number to reach the recipient is required.
If the recipient cannot be reached, refuses delivery, or if the information provided is inaccurate, the order may be postponed or returned to the store. Additional charges may apply.
Product responsibility is transferred to the recipient upon hand delivery.
Peak periods and exceptional conditions
During periods of high demand (particularly Valentine's Day, Mother's Day and the holiday season) or in the event of exceptional weather conditions, delivery times may be adjusted reasonably.
Delivery can be made at any time during the scheduled day or, if necessary and after communication with the customer or recipient, the day before or the day after.
Abaca Florist is committed to making every reasonable effort to meet the announced deadlines.
Limitation of liability
Abaca Florist cannot be held responsible for any delay or inability to deliver resulting from incorrect or incomplete information provided by the customer or recipient.
In the event of a significant delay or non-delivery attributable to Fleuriste Abaca and not resolved within a reasonable time, the customer's recourse will be limited to the reimbursement of the amount paid for the order concerned.
Florist Abaca's total liability, if any, is limited to the amount of the order.
Cancellation and modification
Since the products sold are perishable and made to order, they are excluded from the right of cancellation applicable to distance contracts, in accordance with the exceptions provided for by the Quebec Consumer Protection Act.
Orders already being prepared cannot be cancelled or modified.
Any request for cancellation or modification to a later date must be made as soon as possible by telephone.
Complaints and satisfaction
Any complaint regarding the quality of the delivered product must be made within 48 hours of delivery.
Subject to verification, Abaca Florist may, at its discretion:

proceed to replace the product;

to offer credit;

or issue a refund.
Force majeure
Abaca Florist cannot be held responsible for a failure to fulfill its obligations in the event of force majeure or circumstances beyond its reasonable control, including natural disasters, major storms, breakdowns, accidents or strikes.
Respect for consumer rights
Nothing in these terms and conditions shall be construed as limiting the consumer's rights under the Quebec Consumer Protection Act.
